1. The agreement

These Terms of Service form a binding agreement between you and Backcountry Blueprint LLC, a limited liability company with its principal place of business at 3773 W Grassy Meadow Dr, South Jordan - 84009-3132, United States (US). In these terms the words we, us and our refer to Backcountry Blueprint LLC, and the words you and your refer to the person or organisation using this website or commissioning services.

By browsing this website, sending an enquiry or accepting a scope note, you agree to these terms. If you are accepting on behalf of an organisation, you confirm that you have authority to bind that organisation to this agreement.

Where a signed scope note, proposal or contract exists between us, that document takes priority over these terms to the extent of any conflict. These terms fill the gaps and govern the website in all cases. Nothing in these terms excludes a right that cannot lawfully be excluded.

Please read the whole document before commissioning work. If any part is unacceptable, contact us before proceeding and we can discuss whether an alternative arrangement is possible.

2. Our services

Backcountry Blueprint LLC provides route planning and land-use advisory. The six service lines are route plan drafting, land access reviews, camp site selection, water source mapping, seasonal condition reports and permit guidance. Each line is described in more detail on the services page of this website.

Services are delivered as documents, field records and advisory conversations. We do not build trails, install infrastructure, lead trips, provide medical or safety coverage, sell equipment or act as a booking agent. If a client needs one of those things, we will say so and, where possible, point to a suitable provider, without accepting responsibility for that provider.

We may decline a commission for any lawful reason, including a conflict of interest, a lack of relevant capacity or a concern about the purpose of the work. We are a small practice and we would rather decline than accept work we cannot do properly.

The services are provided on a professional best-effort basis. They are not a substitute for the judgement of a qualified engineer, a licensed surveyor where a statutory survey is required, a lawyer on questions of title or a land manager on questions of access policy.

3. Enquiries and scoping

An enquiry is not an engagement. A message through the contact form, an email or a telephone call begins a conversation and does not oblige either party to proceed.

We respond to enquiries with a scope note that describes the work, the deliverables, the assumed field days, the fee and a dated schedule. The scope note states what is included and, just as importantly, what is not. Work begins only when the scope note is accepted in writing and any agreed deposit has cleared.

Scoping assumptions matter. If the corridor turns out to be longer, the access more complex or the season later than described, we will raise a variation before continuing. We will not quietly absorb an expanded brief and then invoice for it at the end.

Information provided during scoping should be accurate to the best of your knowledge. A route described as having clean access when it does not will lead to a scope that cannot be delivered, and the cost of discovering that falls on the project.

4. Quotes and fees

Quotes are prepared for a defined scope and are valid for thirty days unless the scope note states otherwise. Fees may be fixed for the described work or charged on a time and materials basis where the scope is genuinely uncertain, and the scope note will say which applies.

Travel, subsistence and any third-party charges such as records fees or printing are shown separately. Where an estimate is given for these items, it is an estimate and not a cap, and we will seek approval before exceeding it by a material amount.

Fees are stated in United States dollars unless another currency is agreed in writing. Taxes are added where the law requires them, and the scope note identifies the basis.

If the scope changes after acceptance, we will issue a written variation with the additional fee and any schedule impact. Work on the variation begins when it is accepted. We do not proceed on a verbal instruction alone.

Quotes assume normal conditions. A field day lost to a road closure, a landowner refusal or severe weather may require a return visit, and the scope note sets out how such a visit is charged.

5. Payment terms

Unless the scope note says otherwise, a deposit of one third of the fee is due on acceptance, a further third on issue of the draft package and the balance on final issue. For short assignments we may invoice the whole amount at completion.

Invoices are payable within fourteen days of the invoice date. Payment details are shown on the invoice. We do not accept cash by post and we do not store payment card numbers.

Late payment may attract interest at the rate permitted by applicable law, calculated from the due date until payment is received. We will always send a reminder before applying a charge, because most delays are administrative rather than deliberate.

If an invoice remains unpaid for more than thirty days after a reminder, we may suspend work and withhold further deliverables until the account is settled. Suspension does not remove the obligation to pay for work already performed.

Where a client disputes an invoice in good faith, it should tell us within fourteen days of receipt and pay the undisputed portion. We will investigate the disputed portion promptly and correct any error.

6. Your responsibilities

You agree to provide timely and accurate information about the corridor, the intended use, the party size, the season and any known access restrictions. The quality of our advice depends heavily on the quality of the brief.

You are responsible for obtaining any permission needed to enter land for the field survey, or for telling us clearly that this is part of the assignment. We will not enter private land without a documented basis for access.

You are responsible for the decision to use a route, for the supervision of participants and for compliance with the rules of any land manager or agency. A plan is information, not a guarantee of safe passage.

You agree not to use our documents for a purpose outside the agreed scope without telling us. If a plan is to be shared with a third party or used in a commercial way, we ask to be informed so that we can confirm the document is current.

You agree to keep your own copies of final deliverables. We retain project records as described in the Privacy Policy, but we are not an archive service for the client.

7. Fieldwork and site access

Fieldwork is scheduled in advance and is subject to weather, road conditions, landowner availability and the safety of the survey team. We may postpone a field day where conditions make it unsafe or unproductive, and we will reschedule as soon as practical.

The survey team has absolute discretion to stop work on safety grounds. If a slope, a crossing or an animal presents a risk that cannot be managed, the team will withdraw and report. No fee adjustment applies to a safety withdrawal that was not caused by the client.

Where the client or its representative accompanies the team, the client is responsible for its own equipment, fitness and conduct. The client must follow reasonable safety instructions from the surveyor.

Access to a site may be withdrawn by a landowner at short notice. If that happens, we will document the position and discuss alternatives, which may include a revised corridor or a change to the scope.

8. Deliverables and revisions

Deliverables are described in the scope note. A typical package includes a dated PDF plan set, a field edition with larger type, a map of the corridor and a written note explaining the reasoning. Where access, water or permit work is included, each has its own document.

Two revision rounds are included in a standard drafting scope. A revision round means a consolidated set of comments returned within twenty-one days of the draft issue. Further rounds are charged at the rates in the scope note.

Comments should be specific. A note that says the route feels wrong is difficult to act on; a note that says the second day is too long because the creek crossing adds two hours is something we can fix. We will always try to interpret vague feedback, but specific feedback produces a better final document.

Final issue confirms acceptance of the package. After final issue, changes are handled as a new commission, even if they are small, because the record has been closed.

Deliverables are provided in the formats stated in the scope note. Editable source files are not included unless expressly agreed, because they contain working notes that are not intended as a client document.

9. Nature of the advice

Our advice concerns the planning of routes and the assessment of land use. It is professional advisory work, not a statutory survey, an engineering certification or a legal opinion.

Conditions on the ground change. Snow, flood, fire, construction, vegetation growth and changes in ownership can alter a corridor after the survey. A plan is accurate as at its issue date, and the seasonal condition service exists to keep it current.

We describe uncertainty honestly. Where a source may fail, an access question is unresolved or a camp has a known drawback, the document says so. A client who reads a plan should be able to see what we know, what we assume and what remains open.

Nothing in our documents is a warranty that a route is safe for every person in every condition. Backcountry travel carries inherent risk, and that risk is managed by judgement on the day, not by paperwork alone.

10. Permits and agency decisions

Permit guidance is advisory. We identify the responsible office, list the expected attachments, prepare a supporting narrative and check the package for consistency. You submit the application in your own name.

We do not control agency decisions and we do not guarantee that a permit will be granted, granted on time or granted on the terms requested. Review timelines published by an agency are estimates and may change.

If an agency requests further information, we will help you understand the request and, where it falls within scope, prepare a response. Additional work of that kind may be charged as a variation.

You are responsible for complying with the conditions of any permit or permission, including dates, group size, camp locations and any restrictions on fires, dogs or vehicles.

11. Intellectual property

This website, including its text, layout, illustrations built in code, stylesheets and scripts, is owned by Backcountry Blueprint LLC and is protected by copyright and other laws. You may read, print and share links to the pages for personal and professional reference.

You may not copy the website in whole or in part for a competing service, remove attribution from our documents, or present our material as your own. Short quotations with clear attribution are welcome.

On full payment, the client receives a perpetual, non-exclusive licence to use the final deliverables for the purpose described in the scope note. The licence covers the client organisation and its named contractors, and it does not transfer ownership of the underlying methods and templates.

We retain ownership of our working methods, checklists, drafting templates and software tools. The client receives the product of those methods, not the methods themselves.

We may describe an engagement in general terms for our own portfolio, for example naming the type of corridor and the season, but we will not publish client names, precise locations or identifying details without written permission.

12. Confidentiality

Each party agrees to keep confidential the non-public information it receives from the other in connection with an engagement. This includes landowner details, access negotiations, commercial terms, internal programme information and the contents of the deliverables before they are published by the client.

Confidentiality does not apply to information that is already public, that the receiving party independently develops without use of the confidential material, that is received from a third party without a duty of confidence, or that must be disclosed by law or court order.

Where disclosure is required by law, the party subject to the requirement will, where lawful and practical, notify the other party before disclosing so that protective steps can be considered.

Confidentiality obligations continue after the engagement ends and survive termination of this agreement for as long as the information remains non-public.

13. Third-party information

We rely on public records, agency maps, parcel data and published notices as inputs to our work. We take reasonable care to use current and reputable sources, but we do not warrant the accuracy of third-party data.

Where a record appears inconsistent, we report the inconsistency rather than choosing the convenient version. A client should expect our documents to flag a discrepancy between a county parcel map and an agency boundary, even when it complicates the plan.

Links from this website to third-party sites are provided for reference. We do not control those sites and we are not responsible for their content, availability or privacy practices.

14. Cancellation and postponement

You may cancel an engagement by written notice. If you cancel before the first field day, we will refund any deposit less the value of work already performed and any non-recoverable costs already committed, such as travel bookings or records fees.

If you cancel after fieldwork has begun, you will be invoiced for work performed and for committed costs. Any completed draft remains payable, and we will provide the work performed to that point if the account is settled.

We may cancel an engagement where a conflict of interest emerges, where access cannot be obtained, where safety cannot be assured or where an invoice remains unpaid after due notice. In such a case we will account fairly for work performed and committed costs.

Postponement by mutual agreement is free of charge where at least fourteen days notice is given. A shorter notice period may attract a charge for lost field time, especially where travel has already been arranged.

15. Limitation of liability

Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Subject to that, our total liability arising out of or in connection with an engagement is limited to the total fees paid by the client for the services giving rise to the claim.

We are not liable for indirect or consequential losses, including lost profit, lost opportunity, loss of reputation or the cost of a cancelled programme. We are not liable for losses caused by the client acting against written advice in a deliverable.

We are not liable for delays or failures caused by forces beyond our reasonable control, by the acts of a landowner or agency, or by inaccurate information supplied to us.

Any claim must be notified in writing within twelve months of the date on which the claimant became aware, or ought reasonably to have become aware, of the circumstances giving rise to it.

16. Indemnity

You agree to indemnify Backcountry Blueprint LLC against claims, losses and reasonable costs arising from your breach of these terms, from your use of a deliverable outside the agreed scope, or from information you supplied that you did not have the right to share.

This indemnity does not apply where the loss is caused or contributed to by our own negligence or breach. It is intended to cover third-party claims that arise from the client side of the relationship, not to shift our own responsibility.

If a third-party claim is made, we will notify you promptly and cooperate in the response. You may participate in the defence with counsel of your choosing at your own cost.

17. Website use

You may use this website for lawful purposes connected with the practice. You may not attempt to gain unauthorised access to any system, interfere with the availability of the site, introduce malicious code or scrape the site at a volume that burdens the hosting environment.

The contact form prepares a message in your own email program. Nothing is stored on the website, and you should not rely on the form as a secure channel for highly sensitive information. For confidential material, ask us for an alternative route.

We may suspend or withdraw the website at any time without notice, for example for maintenance or because a service is discontinued. We are not liable for any loss caused by unavailability of the site.

The website is provided as is and as available. We take care to keep the information current, but we do not warrant that every page is complete or free of error.

18. Privacy and data

Our handling of personal information is described in the Privacy Policy, which forms part of the overall relationship between you and Backcountry Blueprint LLC. It explains what we collect, why we collect it, how long we keep it and how you can exercise your rights.

Where an engagement involves information about third parties, such as a landowner or a participant, the client is responsible for having a lawful basis to share that information and for informing the individuals concerned.

Project records are kept for the periods described in the Privacy Policy. If you need a record deleted sooner, contact us and we will assess the request against our legal and professional obligations.

19. Term and termination

These terms apply for as long as you use the website or have an active engagement with us. Provisions that by their nature should survive termination, including confidentiality, intellectual property, liability and governing law, continue to apply after the relationship ends.

Either party may terminate an engagement for material breach that is not remedied within fourteen days of written notice. Either party may terminate immediately where the other becomes insolvent or ceases to operate.

On termination, the client will pay for work performed and committed costs up to the date of termination. We will deliver any completed work for which payment has been made.

Termination does not affect any right or remedy that accrued before the termination date.

20. Governing law and disputes

These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law rules. The courts of Utah have exclusive jurisdiction over disputes, subject to any right that cannot lawfully be waived.

Before starting formal proceedings, the parties agree to attempt to resolve a dispute through good faith discussion for at least thirty days. A short telephone call resolves most disagreements, and we would rather have that call than a letter from a lawyer.

If discussion does not resolve the matter, the parties may agree to mediation with a mediator acceptable to both. Mediation costs are shared equally unless the mediator decides otherwise.

Nothing in this section prevents either party from seeking urgent injunctive relief where necessary to protect its rights.

21. Events beyond control

We are not liable for a delay or failure to perform caused by an event beyond our reasonable control. Such events include severe weather, wildfire, flooding, road closures, public health restrictions, utility or network failure, and action by a government or land manager.

Where such an event occurs, we will notify you promptly, explain the effect on the schedule and propose a revised plan. If the event continues for more than sixty days, either party may terminate the affected part of the engagement and settle the account fairly.

Requirements to obtain access or permission are not usually events beyond control unless the refusal itself was unforeseeable and outside the client responsibility described earlier.

22. Changes to these terms

We may update these terms from time to time to reflect changes in the practice or in the law. The date at the top of the page shows when the current version took effect.

Changes apply to new enquiries and engagements from the date of the update. An engagement that began before the update continues under the terms that applied when it began, unless both parties agree otherwise in writing.

If a change materially affects an active engagement, we will draw it to your attention rather than relying on a website notice alone.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force, and the unenforceable provision is replaced by an enforceable provision that best reflects the original intention.

23. Contact details

Questions about these terms, a scope note or an invoice should be sent to the survey camp. We answer correspondence during business hours and we are happy to explain any clause in plain language.
